Bankruptcy Laws in Ohio
In Ohio, Chapter 7 bankruptcy eligibility involves a means test. The means test uses current monthly income, household information, allowable expenses, and other financial data to determine whether a presumption of abuse may arise. It isn’t an automatic approval or denial. If Chapter 7 isn’t appropriate, Chapter 13 may be an option, but eligibility depends on an individualized review of income, assets, debts, and repayment-plan requirements. Individuals generally must complete approved credit counseling within the required period before filing, subject to limited exceptions.
If you have been contacted by a debt collector, you may be able to file for bankruptcy to get a fresh start. The Fair Debt Collection Practices Act does not limit debt collectors to two contacts per week. When a bankruptcy case is filed, an automatic stay generally begins and can halt many collection actions, although exceptions and limitations apply.

Which Type of Bankruptcy Should You File for?

The most common types of bankruptcy are:
- Chapter 7: A Chapter 7 bankruptcy generally involves liquidation of nonexempt assets and can discharge many qualifying unsecured debts. Liens and debts that may not be discharged require separate analysis.
- Chapter 13: A Chapter 13 bankruptcy involves creating a debt repayment plan that lasts between 3 and 5 years. Individuals with regular income may use a court-approved plan to address debts and, when legal requirements are met, may address arrears while retaining property.
